Welcome to BrandStory Visuals ("Company", "we", "our", "us").

These Terms & Conditions govern your use of our website and services. By accessing our website or purchasing any services, you agree to be bound by these Terms.

1. Company Information

BrandStory Visuals is an Ontario, Canada based creative agency specializing in AI-powered video production, visual content creation, AI spokesperson videos, marketing content, and related creative services.

2. Services

We provide digital creative services including but not limited to:

  • AI-generated videos

  • AI spokesperson videos

  • Product demonstrations

  • Marketing and advertising videos

  • Motion graphics

  • AI-generated imagery

  • Custom creative projects

All services are delivered digitally unless otherwise agreed in writing.

3. Orders and Payments

All orders must be paid in full prior to commencement of work unless otherwise agreed.

Prices displayed on the website are subject to change without notice.

Taxes may apply where required by law.

4. Client Responsibilities

Clients agree to provide:

  • Accurate project information

  • Timely feedback

  • Required assets, branding materials, logos, images, and content

  • Necessary permissions for any materials supplied

The Client warrants that all materials provided do not infringe the rights of any third party.

5. Revisions

Each project includes one (1) revision round unless otherwise stated in the service description.

Additional revisions may be subject to additional fees.

Requests that materially alter the original scope of work may be treated as a new project.

6. Delivery Timelines

Estimated delivery timelines are provided at the start of each project.

Delivery timelines may be extended where delays arise due to:

  • Client feedback delays

  • Missing information

  • Changes in project scope

  • Technical issues beyond our reasonable control

7. Intellectual Property

Upon full payment, the Client receives ownership of the final approved deliverables specifically created for the Client.

BrandStory Visuals retains ownership of:

  • Internal workflows

  • AI prompts

  • Templates

  • Production methodologies

  • Proprietary creative processes

BrandStory Visuals may request permission to showcase completed work in its portfolio, website, social media channels, and marketing materials. Any such use will be subject to the Client's prior approval.

8. AI Generated Content

Our services utilize artificial intelligence tools and technologies.

While we make commercially reasonable efforts to create unique content, we do not guarantee exclusivity of AI-generated outputs.

Clients acknowledge that AI-generated content may contain inaccuracies, inconsistencies, or similarities to other content generated through similar technologies.

9. Confidentiality

BrandStory Visuals treats all client information as confidential.

We will not disclose confidential information to third parties except:

  • As required to perform the services

  • Where required by law

  • With the Client's written consent

This obligation survives completion of the project.

10. Limitation of Liability

To the fullest extent permitted by law, BrandStory Visuals shall not be liable for:

  • Indirect damages

  • Consequential damages

  • Loss of profits

  • Loss of business opportunities

  • Loss of data

Our total liability shall not exceed the amount paid by the Client for the specific project giving rise to the claim.

11. No Guarantee of Results

We do not guarantee any specific business, marketing, advertising, social media, sales, or financial results from our services.

12. Termination

We may terminate services where:

  • The Client breaches these Terms

  • The Client engages in abusive conduct

  • Payment obligations are not met

13. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
